The new 2014 SEN Code of Practice for 0-25 year olds means that mediation will have to be considered by those appealing to the SEND Tribunal unless the disagreement concerns an educational placement.  Mediation is a more creative, flexible and user led dispute solving process than Tribunal. The presence of a highly skilled mediator puts people at their ease so that families, their supporters, local authorities and other participants can understand and be understood to find early agreement where possible. Right to refer a complaint to Tribunal still applies if unsuccessful. Link
